    Random Roger: Malthusian Investing

    A long time reader left the following question yesterday;
    Suppose that you have a history in farming, and you recognize that food supply will be a bigger and bigger issue in the future. Suppose you believe Jeremy Grantham is right that this will be a massive issue, but you can't really execute his idea of buying land.?
    Are there "types" of investments that could act as a proxy for agriculture beyond grain futures ETFs or agriculture equipment manufacturers?

    This is obviously as theme I have been writing about and investing in for a while. It is also one I have spent a lot of time exploring ways to invest in (do a search for Random Roger farmland and you should get quite a few results). We have always maintained at least a small exposure to the theme. Currently we own the PowerShares Water Portfolio (PHO) and the Global X Fertilizer ETF (SOIL) in "large" separate accounts and RRGR.

    As important as I believe thematic investing is I typically only allocate a small percentage to any theme. The Malthusian theme gets about 5% weight in our portfolios.

    What I think the reader is asking is whether or not things like PHO, SOIL or any other ETPs can be effective proxies for the theme. A little over four years ago I posted a list of farmland stocks from various countries and added a little bit of color to the names listed. The nature of the stocks has been to be very volatile, to trade at times like they are going out of business very soon to occasionally looking like Apple (AAPL).

    To zoom out a little, this theme is based on the population expanding meaningfully over the next few decades which, the theory goes, will strain the planet's?ability to produce enough food and water for everyone. This is more of a problem for the future and even Grantham says it will be unlikely to meaningfully effect wealthy nations like the US.

    If the real problem is a couple of decades away then the most that could be hoped for is some general outperformance here and there as opposed to going up 100% every year while the broad market goes up 5% (or whatever). As a microcosm, in the last the three months we've all read and heard a lot about the drought and in that three months SOIL is up almost 14% while the S&P 500 is up a little over 6%. This might be related fundamentally to the drought but it could also be a simple beta benefit; SOIL has a higher beta than the broad market so when the broad market goes up a lot then SOIL could be expected to go up a lot more.

    If it is the case that the recent lift in SOIL is all about beta then the theme means very little right now. The reality is for the most part unknowable so part of thematic investing is to believe in the long term dynamics. With a small nod to Karl Popper, the last three months doesn't disprove the validity of the theme.

    As to the future effectiveness of any proxy chosen for this theme (or any other theme) we are a long way from things getting very serious on a global scale. For now the related stocks seem to be more closely tied to the stock market cycle. Based on past cycles, I would expect that in the next bear market (2013, 2014 or 2015?) that related stocks will get pasted. In the face of the next bear phase the long term prospects will be the same as they are now but the cycle will matter more than the long term prospects, IMO.

    As far as buying actual farm land and either leasing it or otherwise working the land I would say that for now the various equities that would seem to be related will not really capture owning a farm directly. I think that can change as/if the world moves closer to the extreme outcome Grantham envisions (I agree with Grantham?directionally?but not to the same magnitude) and the related equities would start to capture the effect. But to be clear that is not where I think the world is right now.

    I do believe in having exposure but the expectation is for slight outperformance for the time being as opposed to up 100% in an up 5% world as noted above.

    Another reader left his opinion to the original question which included the warning that you could invest in some Malthusian proxy but then the thesis turns out to be incorrect. That can be true of any kind of holding not just one that is part of a theme. This then becomes about position sizing. What is the consequence for being totally wrong about something with 20% of your portfolio versus 5%? Can you live with either? How you answer that question will help in figuring a suitable position size for any type of exposure.

    One last bit on this is that anyone who is remotely interested in this theme, either investing in or just learning about it, should think about it on a global scale not just a domestic scale.

    Here's why Zappos should be making more money from Pinterest.

    New York e-commerce entrepreneur Richie Hecker thinks retailers are doing social all wrong.

    His company, InSparq, makes technology for social commerce, and Hecker tells us they're seeing better results than Zappos, which recently reported that a share on Pinterest only generates 75 cents in new sales on average.

    InSparq's customers see 92 cents per share on average, but that gets a lot better depending on the category?$1.40 for cosmetics retailers, and $5.09 for clothing.

    Zappos, an online shoes and clothing retailer owned by Amazon.com, could be doing things better, according to Hecker. Its Pinterest-sharing tool, for example, just posts an image and a product name. Including some "suggestive copy," Hecker says?for example, "Here's my latest find on Zappos: [product name]"?could boost its results.

    But Hecker has a much simpler suggestion: email. An email share generates $5.90 on average across InSparq's network.

    Groupon, One Kings Lane, and a ton of other retailers have found that email's an effective marketing channel. It's just not as sexy as Facebook or Twitter.?(To its credit, Zappos does include email as a sharing option.)

    With less than a week to go until the ball flies end over end through the New Jersey twilight (unless the team tries to make the replacement officials? heads implode by attempting an onside kick), the NFL has announced that new rules will apply in 2012 for the trade deadline and injured reserve.

    The easy part relates to the trade deadline.? It has been moved from October 16 to October 30.? So instead of the Tuesday after Week Six, trades must happen by 4:00 p.m. ET on the Tuesday after Week Eight.

    The injured reserve rule allows one player per team to be activated from IR after a ?major injury.?? The player must miss at least six weeks of practice.? He may be placed on the active list at least eight weeks after placement on injured reserve.

    Unlike the PUP list, then, the window for returning to practice or returning to action doesn?t close.? Once it?s open, it stays open.

    Patriots owner Robert Kraft has said that, if such a provision had been in place four years ago, the team possibly would have used the designation for quarterback Tom Brady, who tore an ACL in Week One.

    Here?s where it gets complicated.? Because teams already have cut to 75, a special procedure applies for 2012.? As to teams that already have placed players on IR, the player for whom the short-term IR procedure will be used must be placed back on the active roster by 9:00 p.m. ET, August 31.? He?ll then count as one of the final 53.

    Then, after 4:00 p.m. ET on Tuesday, September 4, each team can place one player on the modified IR list.

    This means that teams hoping to use the new IR rule for a player already on injured reserve will have to displace another player for nearly four days, using a roster spot for the injured player and then creating a roster spot next Tuesday, when that player goes back to IR.

    Confused?? Good.? Because it took me an hour to figure it out.

    It will take far less than an hour for you to check out a slice of PFT Live regarding the looming roster reductions, along with admittedly rank speculation about a couple of possible surprise moves.

    Barclays hit by fraud probe over Mideast investors

    (AP) ? Scandal-hit Barclays bank says it's facing yet another investigation ? this one relating to the billions it raised from Middle Eastern investors back in 2008.

    The bank said Wednesday that Britain's Serious Fraud Office was looking into whether Barclays was open enough about what it had paid advisers when it raised more than 5 billion pounds of emergency capital at the height of the global financial crisis.

    The private lifeline helped Barclays avoid the humiliating government bailouts that the Royal Bank of Scotland and Lloyds were forced to accept after high-flying executives overloaded the banks with unsustainable amounts of debt.

    Barclays' corporate reputation is already under siege after scandals over selling small businesses complex financial products they didn't need and revelations that the bank fixed a key market interest rate.

    Obama courts college students returning to campus

    (AP) ? As college students return to campus, President Barack Obama's campaign will be there waiting for them.

    Obama aides sees college campuses as fertile ground for registering and recruiting some of the more than 15 million young people who have become eligible to vote since the 2008 election. As Republicans hold their party convention in Florida this week, the president will make a personal appeal to college voters in three university towns: Ames, Iowa; Fort Collins, Colo.; and Charlottesville, Va.

    Obama's victory four years ago was propelled in part by his overwhelming support among college-aged voters, and polls show him leading Republican rival Mitt Romney with that group in this year's race.

    But the president faces an undeniable challenge as he seeks to convince young people that he is the right steward for the economy as they eye a shaky postgraduation job market.

    Seeking to overcome that economic uncertainty, Obama's campus staffers and volunteers are touting the president's positions on social issues, like gay rights, that garner significant support among young people. Obama has stressed his effort to freeze the interest rates on new federal student loans, a pitch he personalizes by reminding voters that he and the first lady were once buried under a "mountain" of student loan debt after law school.

    They also see a fresh opportunity to court students ? and their parents ? following Romney's pick of Paul Ryan as his running mate. Democrats say Ryan's budget would cut funding for Pell Grants, the federal need-based program for students, and Obama's campaign is running television advertisements in battleground states trying to link Romney to that plan.

    Campaigning last week at Capital University in Ohio, Obama told students that Romney's economic plan "makes one thing clear: He does not think investing in your future is worth it. He doesn't think that's a good investment. I do."

    Obama was scheduled to speak Tuesday at Iowa State University and Colorado State University. The University of Virginia rejected his campaign's request to hold an event on campus Wednesday, saying it would cause the cancellation or disruption of classes on the second day of the semester. The event was instead being held at an off-campus pavilion in Charlottesville.

    White House and campaign officials were closely monitoring Tropical Storm Isaac as it barreled toward the Gulf Coast, but as of late Monday, there were no plans to cancel the president's trip.

    Romney's campaign sees an opportunity to cut into the president's support among young people by pushing a three-pronged economic argument focusing on the nation's high unemployment rate, the soaring cost of college and the national debt.

    "These kids haven't even entered the workforce and they already owe the government a bill for the debt Obama has rung up," said Joshua Baca, the Romney campaign's national coalitions director.

    Obama campaign officials say the start of the new school year is a particularly crucial time to ramp up college registration and make sure those new voters get to the polls. In many of the battleground states, about 50 percent of the college students register to vote on campus after Labor Day, according to the campaign. And even those who are already registered may need to change their address or other personal details after moving to new dorms.

    At the University of Dayton, Daniel Rajaiah encourages his fellow Democrats to carry voter registration forms to class, to parties and around campus in case they find someone who hasn't yet registered. Members of the College Democrats set up tables in the middle of campus a few days a week to catch students walking to class or to the cafeteria.

    "Our game plan this fall is to hit voter registration very hard," said Rajaiah, who is president of the College Democrats of Ohio.

    Obama's campaign said it registered 10,000 voters on college campuses in Ohio last week and signed up 300 new volunteers at colleges in Iowa.

    Four years ago, Obama won two-thirds of the vote among 18- to 29-year-olds, compared with just 32 percent for his Republican opponent, Sen. John McCain, according to exit polls.

    An Associated Press-GfK poll released last week showed Obama again holding a broad advantage among younger voters, with 54 percent of registered voters under 35 saying they would vote for Obama and 38 percent backing Romney.

    How Bain Capital execs lower their taxes - The Term Sheet ...

    FORTUNE -- There has been lots of talk over the past few days about how Bain Capital executives have used management fee waivers?to effectively lower their tax payments (a tactic that is not unique to Bain). Some academics have argued that such waivers are an illegal dodge, while private equity tax attorneys I've spoken with call it "aggressive but accepted by the IRS."

    Here is the basic structure: Bain officially charges 2% management fees to investors in its private equity funds. The idea is to cover overhead, such as salaries, office leases, electric bills, etc. ?But Bain has lots of other business lines (venture capital funds, hedge funds, etc.) that generate sufficient cash flow, so it "waives" the PE fund management fees. Well, sort of. Limited partners still pay the 2%, only it flows directly into the fund, as part of Bain's general partner commitment (which is between 10% and 15% of Bain's total PE fund capital, an unusually high percentage).

    By doing so, Bain partners don't pay ordinary income taxes on their management fees. Instead, they pay at capital gains rates if/when the deals generate profit (because it's now considered carried interest). It appears that the partners irrevocably waive their rights to the returns if the deal returns less than par, although I don't have access to the LPAs that would spell it out more exactly. That said, sources do tell me that Bain partners cannot take waiver-related capital loss on failed transactions.

    Sources sympathetic to such structures cite an IRS ruling (93-27) that specifically seems to allow such waivers, under a notion of partnership risk. Critics say that rule is being perverted, because the risk of loss is so low.

    I'm not well-versed enough in IRS minutia to render legal judgment, but do feel that such structures should be banned going forward. Management fees are a fee for service. As such, they should be taxed as ordinary income. If Bain wants to eliminate management fees altogether, then move to a 0-and-32 structure.

    To be sure, I have no problem with fund managers pushing some of their fees into funds. I think it's a good thing, as it's a tighter alignment of interests. But I don't see why their capital should be cheaper than that of the high-net-worth investors in their funds (who paid taxes on their pre-commitment monies). Doing so, in fact, depresses that alignment.

    Tax law is a funny thing, because certain?strategies aren't black and white. They're subject to interpretation. When I asked a PE tax attorney if what Bain is doing is allowed, she told me that "allowed" and "not allowed" isn't always the right way to think about it. Okay, understood. But some things are explicitly permitted (treating carried interest as capital gains, for example) and other things are explicitly prohibited (taking deductions for work expenses for which I was reimbursed). So let's just add this one to the latter list.

    What can others learn from this sad tale? The time between a separation and divorce is tricky, estate-wise. By law, spouses are entitled to inherit a minimum portion of each other?s assets (a third to a half, depending on the state), and unless they waive that right in a prenuptial agreement, it continues until the divorce is finalized. So it?s best for those who have separated to immediately revise their wills and trusts to leave the soon-to-be-ex no more than the required minimum.

    You won?t be able to change your 401(k) since by federal law that money goes to a spouse, unless he or she has signed a form giving up rights to it. And in many states once a divorce is started you can?t change the beneficiaries of a life insurance policy or IRA until it is finalized.

    It always comes down to planning and not procrastinating when changes need to be made. If Mr. Kinkades wishes had changed he should have gotten his attorney involved. Good adive for us all, good planning is no accident.

    Shifting Storm Path Poses New Challenges for GOP

    Tropical Storm Isaac is veering away from a direct hit on Tampa Bay and toward a potentially large political problem for Mitt Romney and the Republican National Convention delegates poised to nominate him for president.

    The National Weather Service reported on Sunday evening that Isaac was spinning away from the Florida Gulf Coast as it travels north, but forecasters warned that up to 10 inches of rain could still pelt the Tampa area and that water could rise 2 to 4 feet, flooding low-lying areas. The service issued a hurricane warning for metropolitan New Orleans.

    The forecasts buoyed some GOP delegates, who vowed on Sunday to golf, jet ski, and parasail their way through what was supposed to have been their first day of convention business.?

    Isaac may have scuttled Monday?s official events, but Wisconsin?s attorney general, J.B. Van Hollen, summed up the storm?s effect on the spirits the delegates, alternates, and guests gathered here: ?It is not going to rain on their parade.?

    Still, Isaac?s new path poses political risks. It is now on track to slam New Orleans, at hurricane strength, in the middle of the week?just as Romney and Paul Ryan are set to address the convention on national television. The events happen to coincide with the seven-year anniversary of Hurricane Katrina?s landfall on the Louisiana coast.

    Katrina?and the Bush administration?s initial response to it?is such a political albatross that the GOP canceled the first day of its 2008 convention amid fears of appearing callous to the plight of Gulf Coast residents enduring a different hurricane, Gustav, that proved far less damaging.?

    This year, similar concerns over optics have pushed party officials to consider alternative scheduling strategies for the convention?s most-important-for-television moments, including extending activities through Friday. Romney campaign officials denied on Sunday that an extension to Friday was under consideration.

    Party officials announced a shorter and shuffled roster of prime-time speakers, and said that more Isaac-influenced changes could come. Event organizers outside the official convention were leaving open the possibility on Sunday afternoon of canceling Monday events at the last minute if the weather should worsen. Most Monday events were canceled at Liberty Plaza, a temporary event space in a parking lot near the Tampa Bay Times Forum.

    Delegates? most immediate concern is how to spend a Monday suddenly free of official duties.

    Renee Dabbs, a Florida political consultant who has organized the Washington state delegation?s stay at a beachside Holiday Inn in Clearwater, told delegates on Sunday, ?It?s really almost a gift that you?re going to have time, because you?re staying on one of the most beautiful beaches in our state.??

    The contingent agreed. Kirby Wilbur, the state party chairman, said he was thinking about holding a poker tournament to raise money for the party, or ?about parasailing in 70 mph wind.? One delegate said she was hoping to take out a Jet Ski in the Gulf of Mexico. Dino Rossi, the Republican nominee for governor in 2004 and 2008 and Senate in 2010, said he might hit the links. ?I brought my clubs, so I might play if we don?t do anything,? he said. ?Or just go to the beach.?

    Others were more cautious. ?I?m an old farm boy from Missouri; we go pretty well in any weather,? said Missouri delegate Jim Willis, 57. ?But even a farm boy hunkers down when a tornado?s coming. I?ve never been around a hurricane, but you?ve gotta put safety first.?

    The Federal Emergency Management Agency warned Florida residents on Sunday to monitor weather conditions and to prepare for possible storm effects by filling gas tanks, stocking up on cash, and planning evacuation routes.?

    Florida Gov. Rick Scott, who has the authority to mandate an evacuation, is giving delegates and other convention participants a choice to stay in their location. He and Tampa Police Chief Jane Castor said they don?t expect to force evacuation unless the storm alters course.?

    ?If it changes, if it becomes issue of public safety, then we will order people into safety, into shelter,? Castor said during a Sunday press conference.?

    Convention protesters said that the expected wind and rain won?t dampen their plans to march on the convention site on Monday. The Coalition to March on the RNC, a group that includes several Occupy groups from Florida, tweeted Sunday, ?The Republicans have their mansions to weather the storm. We have the streets.?

    Marisol Marquez, one of the lead organizers, said that the group ordered ponchos by the case. ?We also have baggies,? she said.?

    Isaac takes aim at New Orleans

    Tropical Storm Isaac is intensifying and is expected to make landfall late Tuesday or early Wednesday on the northern Gulf Coast as a hurricane, forecasters said on Monday.

    The storm--with sustained winds of 65 mph--is moving northwest at 14 mph. According to the National Weather Service, New Orleans is in the projected path of the storm. Wednesday marks the seventh anniversary of Hurricane Katrina, which devastated New Orleans and the Gulf Coast in late August 2005.

    Hurricane warnings have been issued along the northern Gulf Coast from Morgan City, La., to Destin, Florida. According to the National Hurricane Center, a storm surge between six and 12 feet could threaten the northern Gulf Coast if the storm makes landfall during high tide.

    Isaac was blamed for as many as seven deaths in Haiti on Saturday, and forced the delay of the start of the Republican National Convention in Tampa, where GOP leaders are still mulling how to hold a convention as a hurricane concurrently thrashes the Gulf Coast.

    "Even if the storm largely bypasses this region," the New York Times said, "it holds the risk of creating an uncomfortable split-screen image, especially if it continues barreling toward New Orleans."

    Indeed, several news organizations, including CNN, have already sent staffers the Big Easy to cover the storm. And the Boston Globe, citing senior Romney advisors, said that "there is a distinct possibility that the 2012 Republican National Convention will be cancelled."

    "Consider for a moment the juxtaposition of President Obama marshaling his administration's forces and personally visiting New Orleans or Mobile, Ala., in the aftermath of the storm's landfall," the Boston Globe said, "all while the convention hall is filled with delegates dressed in funny hats listening to partisan speeches."

    On Sunday, Louisiana Gov. Bobby Jindal declared a state of emergency and ordered voluntary evacuations of more than a dozen parishes. Governors in Alabama and Mississippi did, too.

    "I know the anxiety level is high," New Orleans Mayor Mitch Landrieu told CNN on Sunday. "We are much, much better prepared structurally than before."

    A big issue is Isaac's speed. According to Weather.com, the storm is expected to slow as it approaches Louisiana, and could take up to 36 hours--perhaps longer--to move through New Orleans.

    (AP) ? A gunman who killed a former co-worker in cold blood in the shadow of the Empire State Building and then was shot dead by police after he turned his gun on them spent long hours in the quiet of Central Park, photographing hawks and marveling over nature's beauty.

    His victim was a gregarious salesman, beloved by his nieces and nephews as the fun uncle who could talk with equal expertise about the New York Jets and the women's fashion accessories he sold.

    Investigators on Saturday were trying to piece together what caused Jeffrey Johnson, a T-shirt designer, to ambush Steve Ercolino, an apparel company vice president, a day earlier outside the Manhattan offices of the company where they once were colleagues.

    Police said Johnson hid behind a car and then killed Ercolino with five gunshots as he arrived for work. Johnson then was shot by two police officers who confronted him on a busy sidewalk.

    Security camera footage showed the officers had only an instant to react when Johnson suddenly turned as they approached and pointed his gun at them, his arm cocked as if to fire.

    Their encounter was over in eight seconds. The officers, who had been standing nearly close enough to shake hands with Johnson and had no opportunity to take cover, fired almost immediately.

    Nine bystanders were wounded in the 16-shot volley, all by stray or ricocheting police bullets, police confirmed Saturday. None of their injuries was life-threatening, police said.

    Police investigating Johnson's killing of Ercolino were eyeing bad blood between them from when they worked together at Hazan Import, a garment district business where Ercolino was a vice president of sales.

    Johnson and Ercolino had traded harassment accusations when they worked together, police said, and when Johnson was laid off from the company a year ago he blamed Ercolino, saying he hadn't aggressively marketed his new T-shirt line.

    After Johnson's layoff, neighbors said, he continued to leave his apartment every day in a suit.

    Internet records listed Johnson as the administrator of the website for a business called St. Jolly's Art, which sold iron-on graphic art for T-shirts. Art for sale on the site included stylized drawings of fighter planes and muscle cars and whimsical "seafaring vignettes" featuring pirate maidens and tall ships.

    Johnson also was part of a community of bird watchers and photographers who document hawks and other wildlife living in Central Park, a few blocks from his home.

    In one email to another bird watcher who works at The Associated Press, Johnson wrote tenderly about spending a winter night watching ducks in the park.

    "Near midnight by the Harlem Meer I watched a little 'flotilla' of Mallards swimming and softly honking ... fifteen degree temp and they were carrying on unfazed. Just remarkable," he wrote.

    His photographs of Central Park's hawk population appeared regularly on blogs tracking the birds.

    A neighbor who often saw Johnson, 58, said he was always alone.

    "I always felt bad," said Gisela Casella, who lived a few floors above Johnson in a modest apartment building on the Upper East Side. "I said, 'Doesn't he have a girlfriend?' I never saw him with anybody."

    Ercolino, 41, was described by his relatives as the opposite of a quiet loner.

    His eldest brother, Paul Ercolino, said he was a gregarious salesman who often traveled, had a loving girlfriend and was the life of any family gathering.

    "He was in the prime of his life," he said. "He would do anything for anybody at any time. ... He was so wonderful with my children. At Christmastime, he was the one who always had the best presents for the kids."

    Paul Ercolino said his brother, known to nieces and nephews as Uncle Ducky because of his nearly blond hair, had followed his father into the garment industry after growing up in Nanuet, just north of New York City, then later worked in women's handbags and accessories. He said his brother had never mentioned to the family that he had any problems with a co-worker.

    Hazan Import Corp. executives didn't return phone calls seeking comment Friday.

    Johnson, after waiting for Steve Ercolino to come to work, walked up to him, pulled out a .45-caliber pistol and fired at his head, police Commissioner Ray Kelly said. After Ercolino fell to the ground, Johnson stood over him and shot four more times, a witness told investigators.

    "Jeffrey just came from behind two cars, pulled out his gun, put it up to Steve's head and shot him," said Carol Timan, whose daughter, Irene Timan, was walking to Hazan Imports at the time with Ercolino.

    In security camera footage released by the police, Johnson can be seen walking calmly down the sidewalk after the shooting, distancing himself slightly from the other pedestrians, who appear to have no awareness that anything is wrong.

    But when two police officers approach in a hurry, Johnson turns and pulls a handgun from a bag. Then, the scene explodes into action. People seated on a bench behind the gunman and pedestrians standing close to the two officers run for their lives.

    Only a young child seems not to react, strolling out of view of the camera as adults all around leap away in terror.

    Startled New Yorkers later looked up from their morning routines in the crowded business district to see people sprawled in the streets bleeding and a tarp covering a body in front of the tourist landmark.

    "I was on the bus, and people were yelling 'Get down! Get down!" accountant Marc Engel said. "I was thinking, 'You people are crazy. No one is shooting in the middle of midtown Manhattan at 9 o'clock in the morning.'"

    It was over in seconds, he said ? "a lot of pop, pop, pop, pop, one shot after the other."

    Afterward, he saw sidewalks littered with the wounded, including one man "dripping enough blood to leave a stream."

    The officers who fired were part a detail regularly assigned to patrol landmarks such as the 1,454-foot-tall skyscraper since the Sept. 11 attacks, officials said.

    Kelly, the police commissioner, said the officers who confronted Johnson had "a gun right in their face" and "responded quickly, and they responded appropriately."

    "These officers, having looked at the tape myself, had absolutely no choice," he said.

    A witness had told police that Johnson fired at the officers, but authorities say ballistics evidence doesn't support that. Johnson's gun held seven rounds, they said. He fired five times at Ercolino, one round was still in the gun and one was ejected when officers secured it, authorities said.

    A loaded magazine was found in Johnson's briefcase.

    Johnson legally bought the gun in Sarasota, Fla., in 1991, but he didn't have a permit to possess it in New York City, authorities said.

    Mayor Michael Bloomberg said New York still is the safest big city in the country, on pace to have a record low number of murders this year.

    "But we are not immune to the national problem of gun violence," he said of the shooting, following mass shootings at a Colorado movie theater and a Sikh temple in Wisconsin.

    The nine people wounded outside the Empire State Building were all from New York City, except for a woman from Chapel Hill, N.C. They suffered graze wounds or other minor injuries.

    Metal detectors and bag searchers have been standard at the Empire State Building since 1997, when a gunman opened fire on the 86th-floor observation deck, killing one tourist and wounding six others before fatally shooting himself.

    The skyscraper remained open Friday throughout the mayhem, although its workers became witnesses.

    "We were just working here and we just heard bang, bang, bang!" said Mohammed Bachchu, a worker at a nearby souvenir shop.

    He said he rushed from the building and saw seven people lying on the ground, covered in blood.

    Rebecca Fox said she saw people running down the street and initially thought it was a celebrity sighting, but then she saw a woman shot in the foot and a man dead on the ground.

    "I was scared and shocked and literally shaking," she said. "It was like 'CSI,' but it was real."

    Disease Maps Pinpoint Origin of Indo-European Languages

    Turkey might be the geographic origin of languages from English to Hindi, according to epidemiological tracking techniques

    Languages as diverse as English, Russian and Hindi can trace their roots back more than 8,000 years to Anatolia ? now in modern-day Turkey. That's the conclusion of a study that assessed 103 ancient and contemporary languages using a technique normally used to study the evolution and spread of disease. The researchers hope that their findings can settle a long-running debate about the origins of the Indo-European language group.

    English, Dutch, Spanish, Russian, Greek and Hindi might all sound very different, but there are many commonalities, such as the Dutch moeder, Spanish madre and Russian mat', all of which mean "mother". On this basis, researchers have concluded that more than a hundred languages across Europe and the Middle East, from Iceland to Sri Lanka, stem from a common ancestor.

    Some scholars think that Indo-European languages spread with farming techniques from Turkey across Europe and Asia 8,000?9,500 years ago. Others suggest that nomadic ?Kurgan? horsemen brought the origins of Indo-European language from central Asia about 6,000 years ago. There is archaeological evidence to support both theories, but genetic studies of Indo-Europeans have been inconclusive, leading to an intractable debate among linguists, anthropologists and cultural historians.

    Taking sides
    In 2003, Russell Gray and his then doctoral student, Quentin Atkinson, at the University of Auckland in New Zealand generated a maelstrom of controversy by claiming to have solved, by computer modeling, what has been described as ?the most intensively studied, yet still the most recalcitrant, problem of historical linguistics?, coming down on the side of Anatolia4 (see 'Language tree rooted in Turkey').

    Neither Gray nor Atkinson is a linguist. But they believed they could work with the kinds of tools employed in evolutionary ecology to answer important questions about language prehistory.

    Genes and words have several similarities, and language evolution has conventionally been mapped using a "family tree" format. Gray and Atkinson theorized that the evolution of words was similar to the evolution of species, and that the ?cognate? of words ? how closely their sounds and meanings are related to one another ? could be modeled like DNA sequences and used to measure how languages evolved. By extension, the rate at which words changed ? or mutated ? could be used to determine the age at which Indo-European languages diverged from one another.

    Using methods from evolutionary biology, the duo compared common words in 87 Indo-European languages, such as 'mother', 'hunt' and 'sky', to figure out how language ?species? were related to one another. They traced the origins of Indo-European languages to 7,800?9,800 years ago, supporting the Anatolian hypothesis.

    Critics were skeptical. Gray and Atkinson had determined when the languages originated, but not where. So, in a paper published today in Science, Atkinson, Gray and their colleagues address this using the type of geography-based computer modeling normally used by epidemiologists to track the spread of disease1.

    The locations of current Indo-European languages are well known, and the geographic origin of older, extinct languages ? such as Ancient Greek or Sanskrit ? can be inferred from the historical record. In this way, the researchers believed they could track the movement of the Indo-European languages in the same way that epidemiological models trace a disease outbreak to its source. Once again, they conclude that the origin is Anatolia.
