Could Outgoing Republicans Hold Keys to 'Fiscal Cliff'?

The outlook for reaching some sort of bipartisan agreement on the so-called "fiscal cliff" before the Dec. 31 deadline is looking increasingly grim. Shortly after noon today, House Speaker John Boehner, R-Ohio, appeared before the cameras to say the talks had reached a "stalemate."

But there may be a glimmer of hope. There are currently 33 outgoing members of Congress - they're either retiring or were defeated last month - who have signed the Grover Norquist pledge stating that they will not raise taxes. Those members, particularly the ones who have traditionally been somewhat moderate, could hold the key to that stance softening.

"You have 33 people who do not have to worry about the future political consequences of their vote," said ABC political director Amy Walter. "These are people who theoretically can vote based purely on the issue rather than on how it will impact their political future."

One outgoing member has publicly indicated a willingness to join with Obama and the Democrats on a partial deal.

"I have to say that if you're going to sign me up with a camp, I like what Tom Cole has to say," California Republican Rep. Mary Bono Mack said on CNN on Thursday. Cole is the Republican who suggested that his party vote to extend the Bush tax-rates for everyone but the highest income earners and leave the rest of the debate for later. Mack's husband, Connie, however, also an outgoing Republican member of Congress, said he disagreed with his wife.

But in general, among the outgoing Republican representatives with whom ABC News has made contact, the majority have been vague as to whether or not they still feel bound by the pledge, and whether they would be willing to raise tax rates.

"[Congressman Jerry Lewis] has always been willing to listen to any proposals, but there isn't," a spokesman for Rep. Lewis, Calif., told ABC News. "He's said the pledge was easy because it goes along with his philosophy that increasing tax doesn't solve any problems. However, he's always been willing to listen to proposals."

"Congressman Burton has said that he does not vote for tax increases," a spokesman for Dan Burton, Ind., said to ABC.

"With Representative Herger retiring, we are leaving this debate to returning members and members-elect," an aide for Wally Herger, Calif., told ABC News.

The majority of Congress members will likely wait until a deal is on the table to show their hand either way. However, it stands to reason that if any members of Congress are going to give in and agree to raise taxes, these would be the likely candidates.

An agreement will require both sides to make some concessions: Republicans will need to agree to some tax increases, Democrats will need to agree to some spending cuts. With Republicans and Democrats appearing to be digging further into their own, very separate territories, the big question is, which side will soften first?

Genome-scale study ID's hundreds of drug targets for Huntington's

ScienceDaily (Nov. 29, 2012) ? Scientists searching for ways to develop treatments for Huntington's disease (HD) just got a roadmap that could dramatically speed their discovery process. Researchers at the Buck Institute have used RNA interference (RNAi) technology to identify hundreds of "druggable" molecular targets linked to the toxicity associated with the devastating, ultimately fatal disease. The results from this unprecedented genome-scale screen in a human cell model of HD are published in the November 29, 2012 edition of PLoS Genetics.

The work was is a collaboration between Buck Institute faculty members Robert E. Hughes, Ph.D., Sean Mooney, Ph.D., Lisa Ellerby, Ph.D. and Juan Botas, Ph.D. at the Baylor College of Medicine.

HD is a devastating and incurable progressive neurodegenerative genetic disorder that affects motor coordination and leads to severe physical and cognitive decline. Currently, there are about 30,000 people in North America diagnosed with HD and another 150,000 people at risk for developing the disease. The disease pathology stems from a mutation in the huntingtin gene (HTT), resulting in the accumulation of a toxic protein leading to neuronal cell death and systemic dysfunction. Buck Scientists screened more than 7,800 genes pre-selected as potential drug targets to identify modifiers of HD toxicity in human cells, using technology that silences specific genes prior to analysis.

Lead author Robert Hughes said that among the diverse range of modifiers identified, this study showed that RRAS, a gene involved in cell motility and neuronal development, is a potent modulator of HD toxicity in multiple HD models. "Our data indicates that the pathogenic effects of the HTT mutation on this pathway can be corrected at multiple intervention points and that pharmacological manipulation of RRAS signaling may confer therapeutic benefit in HD," Hughes said. Follow up work on the RRAS pathway is now underway in the Hughes lab and in the lab of Buck faculty member Lisa M. Ellerby, PhD.

Hughes said many molecular hits identified in the screening were validated in human cell, mouse cell and fruit fly models of HD -- and that all the data from the study will be available to the public. "Our hope is that HD researchers will look at these targets and find modifiers relevant to the areas they already work on," said Hughes. "Ideally, pharmaceutical companies already working on some these pathways could build on their current knowledge and expertise by focusing their attention on the challenge to develop therapies for HD."

Gilda's Club Changes Name to Cancer Support Community ...

Gilda?s Club is a network of cancer charities that help patients cope with the disease. It is named after Gilda Radner, an original Saturday Night Live cast member, who died in 1989 of ovarian cancer. She said the disease gave her ?membership in an elite club I?d rather not belong to.? The Madison,?Wisconsin?branch of the organization announced they?re changing their name to the Cancer Support Community in January 2013, leaving Gilda?s legacy behind, and other branches are following suit. This isn?t okay.

In 2009, Gilda?s Club joined with The Wellness Community to form the Cancer Support Community, but local branches of Gilda?s Club kept their name. Until now. The executive director of Gilda?s Club Madison, Lannia Syren said, ?One of the realizations we had this year is that our college students were born after Gilda Radner passed, as we are seeing younger and younger adults who are dealing with a cancer diagnosis.?

The concern on their end seems to be that young cancer patients won?t come to them for help because they don?t know who Gilda Radner is, so the name no longer conveys what the organization does. It?s understandable that they want to make it clear to people what they do, but why not change the name to Gilda?s Cancer Support Community. Her quote about being in an ?elite club? is a good line, but it can be forgotten. She shouldn?t be.

So, since Schwartz threw the flag and essentially created a duplicitous request for a review, everything is cool, right?

The Ethics of Not-For-Profit Organizations Capitalizing on Small ...

The Program is only available to qualifying small businesses. For the purpose of this Program, qualifying small businesses include small, locally-owned storefront and online businesses with $10 million in annual revenue or less. Businesses in the following industries are excluded: government agencies, charities, non-profits, trade associations, shopping property management firms, political, religious and educational organizations.

?It seems pretty clear that shuls, yeshivas, tzedaka organizations, and any other frum (or not frum) Not-For-Profit would not be eligible to participate in SBS. (And by the way, we were able to find a few Churches that asked for $25 donations on SBS).

But things are not so simple.

First of all, AMEX knows which vendors are NFPs or religious institutions. Yet, they accept SBS submissions from these vendors. This seems to be in defiance of their own rules. Further, at least a few institutions contacted AMEX and asked if they were in fact eligible for SBS and AMEX told them that they were eligible! Once again, AMEX defied their own rules. Complicating things even worse is the fact that AMEX told several other institutions that they were not eligible for SBS.

Turns out, AMEX has no idea what they are doing. Different organizations were told different things and they don?t even know their own rules. So what?s the verdict?

Here is what I think. If you asked AMEX and they said your organization is not eligible, there is no question that you should not be participating. Yes, that is even if they will accept your charges. Taking advantage of their mistake when you know that they are making a mistake is unethical. Sure, ?taus akum? is permissible. But that doesn?t mean you?should?take advantage. And it might only apply after the mistake happened, but to knowingly take advantage of a mistake is different.

If you asked AMEX and they said your organization is eligible and you did not know that their own rules said that your organization was not eligible, I have no problem with your organization participating in SBS. I don?t love it, but it?s hard for me to complain.

If you asked AMEX and they said?your organization is eligible and you?did?know that their own rules said that your organization was not eligible, I think you should still refrain from participating in SBS. While it is true that someone at AMEX told you that you could participate, you knew that you could not participate. It seems difficult for me to sign off on that. Just because a call-center agent doesn?t know AMEX?s rules doesn?t exonerate you from following those rules. Imagine one idiot police officer told you that you could drive 80 in a clearly marked 55 MPH zone and another officer pulls you over for speeding. You?re not going to be able to blame it on the first officer. You?re going to get a citation. It?s not the exact same thing, but it?s close.

If you didn?t ask AMEX if your organization could participate I think you might think that ignorance is bliss. But it?s not. If you are going to participate in a promotion like this, especially one that involves free money, you need to do your due diligence. You need to make sure you can participate. If you didn?t even care to look into it, I find that problematic.

I hope that at the very least, AMEX will clarify their position for SBS 2013 and the halachically conscious public will be sure to ascertain their eligibility before spamming their supporters to ?spend $25? on a donation to their institution.

Thomas Friedman Has Some Dumb Ideas About Who Should Be Secretary Of State

As most of you may know, Hillary Clinton will be stepping down from her current position as the U.S. Secretary of State, and the reelected President Barack Obama will want to fill her shoes rather quickly. The smart money, at the moment, is that he will appoint U.S. Ambassador Susan Rice to the position, over (or, perhaps, because of) the objections of Sen. John McCain (R-Ariz.) and his pals Sens. Lindsey Graham (R-S.C.) and Kelly Ayotte (R-N.H.), and not Massachusetts Sen. John Kerry (D). Kerry, while qualified, would trigger a special election in Massachusetts, which could return Scott Brown to the Senate, which would make the margins the Democrats would have to defend in 2014 tighter, et cetera.

Of course, New York Times columnist Thomas Friedman has his own idea about who the Secretary of State should be, and, as you might expect, it is a stupendously idiotic notion:

I don?t know Rice at all, so I have no opinion on her fitness for the job, but I think the contrived flap over her Libya comments certainly shouldn?t disqualify her. That said, my own nominee for secretary of state would be the current education secretary, Arne Duncan.

Terrific. Thomas Friedman hasn't bothered to check into Susan Rice's qualifications, but he's pretty sure the thing to do here is to install Obama's mediocre secretary of education and his zero years of foreign policy experience, to run the State Department. Why would Thomas Friedman -- who, I'll remind you, is supposed to be a credible voice on geo-political thinking -- think this is a good idea?

"I?m nominating him," he says, "because I think this is an important time to ask the question of not just who should be secretary of state, but what should the secretary of state be in the 21st century?"

The 21st century has actually been going on for some time now, so this question actually has already has been answered, but let's see where this is going.

Let?s start with the obvious. A big part of the job is negotiating. Well, anyone who has negotiated with the Chicago Teachers Union, as Duncan did when he was superintendent of the Chicago Public Schools before going to Washington, would find negotiating with the Russians and Chinese a day at the beach. A big part of being secretary of education (and secretary of state) is getting allies and adversaries to agree on things they normally wouldn?t ? and making them think that it was all their idea. Trust me, if you can cut such deals with Randi Weingarten, who is president of the American Federation of Teachers, you can do them with Vladimir Putin and Bibi Netanyahu.

Wait. Is Thomas Friedman -- respected, Davos-attending, Cairo hotel-staying, paywall-enhanced Thomas Friedman -- seriously telling his readers that negotiating with teachers unions is the equivalent of negotiating with Vladimir Putin and Bibi Netanyahu? That would be, say, a fine joke for TV host Jay Leno to tell at Duncan's roast, but surely Friedman is not framing his rationale around the sincere belief that deal-making with the AFT prepares you to sit at the table with Likud Party powerbrokers, right? In his next paragraph, he is going to tell us he is kidding, and then get to the real point he wants to make.

A big part of the job of secretary of state is also finding common ground between multiple constituencies: Congress, foreign countries, big business, the White House, the Pentagon and the diplomats. The same is true for a school superintendent, but the constituencies between which they have to forge common ground are so much more intimidating: They?re called ?parents,? ?teachers,? ?students? and ?school boards.?

No, no. I see that Friedman truly believes that negotiating with the players in the public school system actually qualifies you to run the State Department, somehow.

So, okay, here are a bunch of things that shouldn't actually need to be said, but we'll say anyway, because Thomas Friedman is an airhead. Unlike, say...Vladimir Putin, no one has ever had the occasion to wonder, "Hmmm. What's Randi Weingarten playing at?" That's because it's no mystery what Weingarten is after -- she wants better pay and benefits and job security for public school teachers.

What's more is that "negotiating with teachers' unions" is not actually that special an activity. People successfully broker deals with teachers' unions all the time. There are literally hundreds of people who have "cut deals" with Weingarten. By Friedman's reckoning, we should thus be drowning in people capable of taking on Putin. This is not to say that Weingarten isn't a shrewd negotiator or tough-minded, but I rather think that dealing with Weingarten is a task that doesn't come with a whole bunch of dire risks or odd surprises. (I'm prepared to re-assess this if Weingarten starts successfully assassinating journalists, though.)

So what is this really all about? Is there a deeper point here?

There is a deeper point here: The biggest issue in the world today is growth, and, in this information age, improving educational outcomes for more young people is now the most important lever for increasing economic growth and narrowing income inequality. In other words, education is now the key to sustainable power. To have a secretary of state who is one of the world?s leading authorities on education, well, everyone would want to talk to him. For instance, it would be very helpful to have a secretary of state who can start a negotiating session with Hamas leaders (if we ever talk with them) by asking: ?Do you know how far behind your kids are?? That might actually work better than: ?Why don?t you recognize Israel??

This is not so much a "deeper point" as it is a flurry of Friedman's favorite buzzwords, jammed together in one paragraph that doesn't actually mean anything. What sort of "growth" is Friedman talking about? Economic growth? Institutional growth? Better Wi-Fi in hotel bars? Were educational outcomes really not an important lever of economic mobility, prior to the "information age," as Friedman says? What does he mean by "sustainable power?" Is he talking about political power? Or is he literally talking about energy?

If, as Friedman suggests, "everyone would want to talk" to a person who is "one of the world?s leading authorities on education," how does he explain the fact that there are no examples, in history, of a foreign leader demanding to talk to the secretary of education -- or, indeed, any education expert ever -- before they'd consent to a diplomatic deal with the United States?

The real question, right now, is what is it that Duncan has done, in particular, that makes Friedman believe that he should be the secretary of state in Cloudcuckooland?

Math is the answer. Education is the answer. Getting the Middle East to focus on that would do more to further our interests and their prosperity than anything else. As we are seeing in Egypt, suddenly creating a mass democracy without improving mass education is highly unstable.

At the same time, as our foreign budget shrinks, more and more of it will have to be converted from traditional grants to ?Races to the Top,? which Duncan?s Education Department pioneered in U.S. school reform. We will have to tell needy countries that whoever comes up with the best ideas for educating their young women and girls or incentivizing start-ups or strengthening their rule of law will get our scarce foreign aid dollars. That race is the future of foreign aid.

Sweet fancy Moses. Really? "Race To The Top" is what has convinced Friedman that Duncan is ready to take on Putin?

Let me try to talk some sense here. "Race To The Top" is actually not a new or special thing. It's not some exciting, "information age" innovation for this hot and flat and crowded epoch. It is not even a "race" to the "top!" You should actually think of "Race To The Top" as a collection of grant applications from school systems that are already at the top, competing with one another for federal money. (You should also think of "Race To The Top" as "not a particularly effective education initiative," but Diane Ravitch already wrote that column.)

So, let's think about what Friedman is saying here for a minute (which is about 54 more seconds than Friedman himself thought about this). According to Friedman, we should award foreign aid according to the same principles that "Race To The Top" rewards school systems. But in order to win "Race To The Top" money, you already have to have a high-performing, high-functioning school system. I can completely understand the need to keep foreign aid from falling into the hands of corrupt, despotic regimes, but Friedman is implying that the "future of foreign aid" entails our taxpayer dollars flowing to the countries that need our aid the least. This basically defies all logic and good sense.

Friedman says that what powers his belief that the secretary of education should be the secretary of state is that "today?s secretary of state has to deal with so many more failed or failing states." But that's precisely why his "Race To The Top" analogy doesn't work -- "Race To The Top" is explicitly designed to boost the efforts of "states" that are already runaway successes.

Friedman can't seem to grasp the distinction. He says that, in terms of the State Department's activities, that a "lot of countries will need to go back to the blackboard, back to the basics of human capacity building, before they can partner with us on anything." If that is true, then Duncan is perhaps the least suited to the task, because his key innovation is a challenge-grant competition that rewards school systems that demonstrate that they have no "need to go back to the blackboard." School systems that "need to go back to the blackboard" do not win Race To The Top funding.

"So while we?re not likely to shift our secretary of education to secretary of state," Friedman insists, "let?s at least understand why it is not such a preposterous idea."

Well, one person who thinks it is a preposterous idea is Duncan himself, who compares Friedman's article to a piece from The Onion that suggested he should become an "erotic dancer." Says Duncan: "The Onion is probably more accurate than Tom Friedman."

The irony, of course, is that by correctly assaying the comparative value of The Onion versus the value of Thomas Friedman, Duncan is actually demonstrating some small amount of foreign policy acumen.

Tablets 2012: As competition abounds, the iPad hangs onto its crown

Non-iPads from Amazon, Google, Microsoft and others are flooding the market, bringing more diverse experiences, often at better prices than the iPad and its little sibling, the iPad Mini.

Doesn?t matter. Odds are, you?ll still ask Santa for an Apple tablet. And new research suggests Apple iPads large and small will dominate this rapidly growing business, at least through 2013.

OK OK, you're thinking, "Thanks for the newsflash, fanboy." But seriously, in a universe where shoppers operate on cold logic and ever-tightening budgets, the iPad should fall under the wheels of Android any minute now, the same thing that happened with smartphones. So how does Apple maintain its grip?

It's not design or ease of use. Although they surely contribute to customer loyalty, they're not enormous differentiators any more. (Don?t believe me? Ask Apple?s patent lawyers.)

So what?s the answer? Tablets aren?t smartphones and they?re not PCs. While the Android camp waited for a bounce?from the successful phone business, and Microsoft and the computer vendors groped for a bridge between PCs and tablets, Apple made this middle ground the iPad's kingdom.

Heated competition
In the fall of 2011, when Amazon and Barnes & Noble axed their tablet prices down to under $200, Apple held its $499 starting point.

Logic suggested that the iPad would lose its lead, or at least, its majority. The non-Apple upstarts did see spikes in shipments over the 2011 holiday quarter, according to NPD DisplaySearch, a top global research firm. But by mid-2012, Apple was once again shipping over two thirds of the world?s tablets.

This fall, the non-iPads redoubled their attack. Asus and Samsung teamed up with Google to create Nexus-branded 7-inch and 10-inch tablets (respectively). Amazon multiplied its Kindle Fire by three, and dropped the entry-level 7-inch tablet's price down to $159. Barnes & Noble launched a video service and put out a 9-inch tablet at the unheard-of price of $269.

Meanwhile, Microsoft, the sleeping giant, finally addressed the bite iPad is taking out of PC sales by launching its own tablet. Or is it a PC? Whatever it is ? and believe me, the debate still rages ? the $499 Surface RT with its clever keyboard add-on and its full version of Microsoft Office was built to challenge the notion that an iPad can satisfy most computerly needs.

Apple's response to the increased competition made sense ... sort of. It jacked up the specs on its flagship 9.7-inch tablet, and addressed the growing interest in 7-inch tablets by popping out the iPad Mini, a 7.9-inch model. But Apple priced the Mini at $329 ? well above devices from Amazon, Barnes & Noble and Google. And the screen on the Mini doesn't measure up, resolution-wise, to those same cheaper competitors.

Again, doesn?t matter.

Apple ? or at least, the 9.7-inch and 7.9-inch displays unique to Apple ? will account for two thirds of tablets shipped through 2013, according to a forecast from NPD DisplaySearch, which uses research from over 140 display component manufacturers around the globe.

A recent study from Nielsen tells a similar story, at least for kids writing letters to Santa. Nearly half of surveyed U.S. kids between the ages of 6 and 12 want an iPad, and 36 percent want an iPad Mini. Even respondents age 13 and up said the iPad was No. 1. (While a ?Tablet computer other than iPad? also rated relatively highly, the only specific non-iPad to reach double-digit demand in either survey was the Kindle Fire.)

What tablets aren?t
Unlike smartphones, there is no inherent reason to buy a tablet. (Don?t kid yourself.) Most if not all tablet households already have a PC, so people don't need to use an iPad to set up their routers, archive their photos or whatever else a full-blown PC might be especially good for. What an iPad does is fulfill the needs of a secondary computer, without the hassle.

While tablets can replace PCs, they aren't PCs, and thank God for that.

Even in the business world, this PC replacement is gaining momentum. This past week, Barclays Bank made news by buying 8,500 iPads for use in branches, what is being called the biggest purchase of the tablets by a financial services firm.

"On the business side ??and on the consumer side ? it's about the apps,? says Paul Semenza, senior vice president of?analyst services for NPD?DisplaySearch, whose firm has identified that tablets are eating into PC sales. Enterprise-focused apps by the likes of Salesforce, Cisco and Oracle mean that an iPad can provide a convenient way to do highly specialized work quickly on a touchscreen, "rather than having to crack open the notebook."

In confirming the iPad as ?winner and still champ,? Consumer Reports? Jeffrey Fox also cites apps: "With dozens of Android-based models nipping at its heels, the iPad managed to not only hold its own, but up the ante for performance. When you add to that the breadth and quality of its apps, the iPad is still the tablet to beat."

Apple?s commanding lead in tablet-friendly apps ? over 275,000 built specifically for the iPad?s larger screens, versus the underwhelming handful?of tablet-specific apps?available in the?Google Play store ? helps keep it on top. A key reason for the App Store?s initial success is that Apple has its customers trained to spend money, something Google has never really been able to do. When developers release iPad apps, they expect to get paid by the download; to spend time and money bringing the same app to another platform, they must first calculate the risks and rewards.

This can be a vicious circle: If nobody's paying for Android tablet?apps, new ones won't be quick to show up, and then nobody will buy the tablets ... because of a lack of apps. Google has revamped its Google Play store, combining apps with movies and music, in?the hope that at least some customers would?start paying for some content.

But there's more to it than just numbers: There?s increasing evidence that iOS users are far more engaged than Android users. NetMarketShare data reported in Fortune last June say that the share of mobile Internet usage for iOS had reached 62 percent, while the far greater population of Android devices hadn?t quite reached 20 percent.

A fresh study by IBM takes it further: Nearly 10 percent of all online shopping over Black Friday was done on iPads, beating "any other tablet or smartphone," says the tech firm. iPhones made up 8.7 percent, while Android was down at 5.5 percent. The so-called ?iPad Factor? is even more pronounced when compared to other tablets: It represented 88.3 percent of tablet online shopping, followed by the Barnes & Noble Nook at 3.1 percent, Amazon Kindle at 2.4 percent and the Samsung Galaxy at 1.8 percent, says IBM's press release.

And that's why makers of Android tablets should be afraid, because when it comes to tablets, the desire for engagement must precede the tablet purchase.

Amazon and Barnes & Noble have had more luck than other non-Apple tablets in grabbing market share, at least in short bursts, because their tablets come with a built-in sales argument: Buy this to enjoy books and videos to your heart's content.

Amazon has the added advantage of customers who spend so frequently that they keep their credit cards on file, and enough revenues that it can sell tablets at cost, hoping to see profits through media sales.

But while the $70-per-year Amazon Prime video service is nice, its library is not as nice as the omnipresent Netflix's, and the service itself has a large base of customers who signed up for shipping perks, not streaming TV shows.

Most importantly, Amazon makes most of its digital products available on competing iPads, too. The customer's dilemma becomes: "Do I go cheap and get an Amazon-focused experience? Or do I spend more for a broader platform that includes Amazon's services and a lot more?" Apple may push its own services pretty hard, but the flowering of the App Store means that the iPad has become a crossroads of Internet experiences.

All of these factors mean that the iPad,?this expensive-ish not-quite-a-PC that was laughed at when it launched in 2010,?will hold onto its crown for the foreseeable future, as alternatives continue to scramble for relevance. In the smartphone world, someone shopping for an iPhone may well settle for a cheaper Android phone. Yet when it comes to tablets, someone who decides not to buy an iPad may simply choose nothing at all.

Last week?s sweeping power grab by Egypt?s President Mohammed Morsi has thrown the country?s political elite into crisis, and prompted tens of thousands of Egyptians to take to the streets in protest. But much of the fury over his most recent moves probably has more to do with the way he chose to act than what he has actually done.

The conflict roiling the Arab world?s most populous country has been painted by some international observers and many regular Egyptians as a struggle between autocratic Islamists and democratic secularists. Indeed, Morsi and the Muslim Brotherhood party have angered many with how they managed to win power democratically and then tried to consolidate it by decrees.


In a move quickly pounced on by critics, Morsi?s decree last week gave the body charged with writing a draft constitution two more months to finish its work. The decree essentially prevents challenges to the president's rule until the end of the two-month transitional period so that any decision made by Morsi cannot be questioned by the judiciary.

If the so-called constituent assembly, the elected constitutional body that is now dominated by Islamists, would have dissolved, it would have been seen as a victory by many liberal and secular Egyptians.

But Morsi?s decree will allow the assembly to finish its essential work, Henry Smith of the international consultancy Control Risks told NBC News.

"There was a risk that the body writing the constitution would be disbanded by legal judgments but according to his decree, we should see a draft in February," he added. "And if that is decided then we could have a new constitution by mid-2013."

As the struggle of the constituent assembly shows, Morsi and his government have been locked in a struggle with the judiciary.

And however dictatorial Morsi?s recent moves may have been, the judiciary is no paragon of democracy. Indeed, even many of the Brotherhood?s opponents think the judiciary is corrupt and packed with loyalists of deposed dictator Hosni Mubarak.

The lack of accountability for the killing of protesters during the 2011 revolution illustrates why many Egyptians do not trust the judiciary. None of the former regime officials brought to trial for these deaths has been convicted.

The judiciary also upheld the dissolution of parliament, halting essential efforts, such as reforming fiscal and economic policies meant to liberalize and jump-start the economy.

According to liberal and secular parties, the president ?didn't consult with them before issuing his decree on Thursday -- a claim disputed by Morsi's Freedom and Justice Party ? thus losing the opportunity to be seen as a leader willing to reach across political divides and interested in creating consensus.

And those protesting his power grab have reason to be suspicious. After all, Mubarak promised to be a one-term president at the beginning of what ended up as a 30-year rule.

In the end, Egypt is new to the art of politics and its actors unused to sharing power and debating issues publicly.

As international consultant Smith says: "Putting aside some of the autocratic elements of his recent decree, Morsi?s move could be seen as a positive move."

Bitter struggle over Internet regulation to dominate global summit

SAN FRANCISCO (Reuters) - An unprecedented debate over how the global Internet is governed is set to dominate a meeting of officials in Dubai next week, with many countries pushing to give a United Nations body broad regulatory powers even as the United States and others contend such a move could mean the end of the open Internet.

The 12-day conference of the International Telecommunications Union, a 157-year-old organization that's now an arm of the United Nations, largely pits revenue-seeking developing countries and authoritarian regimes that want more control over Internet content against U.S. policymakers and private Net companies that prefer the status quo.

Many of the proposals have drawn fury from free-speech and human-rights advocates and have prompted resolutions from the U.S. Congress and the European Parliament, calling for the current decentralized system of governance to remain in place.

While specifics of some of the most contentious proposals remain secret, leaked drafts show that Russia is seeking rules giving individual countries broad permission to shape the content and structure of the Internet within their borders, while a group of Arab countries is advocating universal identification of Internet users. Some developing countries and telecom providers, meanwhile, want to make content providers pay for Internet transmission.

Fundamentally, most of the 193 countries in the ITU seem eager to enshrine the idea that the U.N. agency, rather than today's hodgepodge of private companies and nonprofit groups, should govern the Internet. The ITU meeting, which aims to update a longstanding treaty on how telecom companies interact across borders, will also tackle other topics such as extending wireless coverage into rural areas.

If a majority of the ITU countries approve U.N. dominion over the Internet along with onerous rules, a backlash could lead to battles in Western countries over whether to ratify the treaty, with tech companies rallying ordinary Internet users against it and some telecom carriers supporting it.

In fact, dozens of countries including China, Russia and some Arab states, already restrict Internet access within their own borders, but those governments would have greater leverage over Internet content and service providers if the changes were backed up by international agreement.

Amid the escalating rhetoric, search king Google last week asked users to "pledge your support for the free and open Internet" on social media, raising the specter of a grassroots outpouring of the sort that blocked American copyright legislation and a global anti-piracy treaty earlier this year.

Google's Vint Cerf, the ordinarily diplomatic co-author of the basic protocol for Internet data, denounced the proposed new rules as hopeless efforts by some governments and state-controlled telecom authorities to assert their power.

"These persistent attempts are just evidence that this breed of dinosaurs, with their pea-sized brains, hasn't figured out that they are dead yet, because the signal hasn't traveled up their long necks," Cerf told Reuters.

The ITU's top official, Secretary-General Hamadoun Tour?, sought to downplay the concerns in a separate interview, stressing to Reuters that even though updates to the treaty could be approved by a simple majority, in practice nothing will be adopted without near-unanimity.

"Voting means winners and losers. We can't afford that in the ITU," said Tour?, a former satellite engineer from Mali who was educated in Russia.

Tour? predicted that only "light-touch" regulation on cyber-security will emerge by "consensus," using a deliberately vague term that implies something between a majority and unanimity.

He rejected criticism that the ITU's historic role in coordinating phone carriers leaves it unfit to corral the unruly Internet, comparing the Web to a transportation system.

"Because you own the roads, you don't own the cars and especially not the goods they are transporting. But when you buy a car you don't buy the road," Tour? said. "You need to know the number of cars and their size and weight so you can build the bridges and set the right number of lanes. You need light-touch regulation to set down a few traffic lights."

Because the proposals from Russia, China and others are more extreme, Tour? has been able to cast mild regulation as a compromise accommodating nearly everyone.

Two leaked Russian proposals say nations should have the sovereign right "to regulate the national Internet segment." An August draft proposal from a group of 17 Arab countries called for transmission recipients to receive "identity information" about the senders, potentially endangering the anonymity of political dissidents, among others.

A U.S. State Department envoy to the gathering and Cerf agreed with Tour? that there is unlikely to be any drastic change emerging from Dubai.

"The decisions are going to be by consensus," said U.S. delegation chief Terry Kramer. He said anti-anonymity measures such as mandatory Internet address tracing won't be adopted because of opposition by the United States and others.

"We're a strong voice, given a lot of the heritage," Kramer said, referring to the U.S. invention and rapid development of the Internet. "A lot of European markets are very similar, and a lot of Asian counties are supportive, except China."

Despite the reassuring words, a fresh leak over the weekend showed that the ITU's top managers viewed a badly split conference as a realistic prospect less than three months ago.

The leaked program for a "senior management retreat" for the ITU in early September included a summary discussion of the most probable outcomes from Dubai, concluding that the two likeliest scenarios involved major reworkings of the treaty that the United States would then refuse to sign. The only difference between the scenarios lay in how many other developed countries sided with the Americans.

ITU officials didn't dispute the authenticity of the document, which was published by Jerry Brito, a researcher at the Mercatus Center at George Mason University as part of a continuing series of ITU-related leaks.

Tour? said that because the disagreements are so vast, the conference probably will end up with something resembling the ITU's earlier formula for trying to protect children online ? an agreement to cooperate more and share laws and best practices, perhaps with hotlines to head off misunderstandings.

"From Dubai, what I personally expect is to see some kind of principles saying cyberspace is a global phenomenon and it can only have global responses," Tour? said. "I just intend to put down some key principles there that will lay the seeds for something in the future."

Even vague terms could be used as a pretext for more oppressive policies in various countries, though, and activists and industry leaders fear those countries might also band together by region to offer very different Internet experiences.

In some ways, the U.N. involvement reflects a reversal that has already begun.

The United States has steadily diminished its official role in Internet governance, and many nations have stepped up their filtering and surveillance. More than 40 countries now filter the Net that their citizens see, said Ronald Deibert, a University of Toronto political science professor and authority on international conflicts in cyberspace.

Google Executive Chairman Eric Schmidt said this month that the Net is already on the road to Balkanization, with people in different countries getting very different experiences from the services provided by Google, Skype and others.

This month, a new law in Russia took effect that allows the federal government to order a Website offline without a court hearing. Iran recently rolled out a version of the Internet that replaced the real thing within its borders. A growing number of countries, including China and India, order sites to censor themselves for political, religious and other content.

China, which has the world's largest number of Internet users, also blocks access to Facebook, YouTube and Twitter among other sites within its borders.

The loose governance of the Net currently depends on the non-profit ICANN, which oversees the Web's address system, along with voluntary standard-setting bodies and a patchwork of national laws and regional agreements. Many countries see it as a U.S.-dominated system.

The U.S. isolation within the ITU is exacerbated by it being home to many of the biggest technology companies - and by the fact that it could have military reasons for wanting to preserve online anonymity. The Internet emerged as a critical military domain with the 2010 discovery of Stuxnet, a computer worm developed at least in part by the United States that attacked Iran's nuclear program.

Whatever the outcome in Dubai, the conference stands a good chance of becoming a historic turning point for the Internet.

"I see this as a constitutional moment for global cyberspace, where we can stand back and say, `Who should be in charge?' said Deibert. "What are the rules of the road?"

'Revenge' Scoop: Madeline Stowe Talks Jack And Amanda's Wedding And Hints 'A Couple' Will Die

Get ready for a lot of drama on "Revenge."

As Nick Wechsler, aka Jack Porter, told HuffPost TV last week, the Amanda does get shipwrecked, as the season 2 premiere revealed -- and someone goes down with the beloved boat. But, much like the first season with Daniel's (Josh Bowman) beach shooting, creator Mike Kelley likes to keep the fans and cast guessing.

"That's the thing: We don't know who this is on the boat," Wechsler told us.

But now Madeleine Stowe, who plays Victoria Grayson on the hit ABC show, is spilling some more secrets.

The actress tells TVLine.com, ?I sort of know who?s on it -- but there might be more than one person. I think Mike is actually still deciding.?

It's being assumed the boat will sink sometime before/during/after Jack and Amanda's impending nuptials, which could bring out numerous Hamptonites. So, could Victoria Grayson be a victim? Stowe isn't counting her character out.

As for the awaited Porter wedding, Stowe says it's definitely going to happen and that there will "at least be one death. Although she adds "a couple" might be a better assumption.

?We?ll see who gets blamed for it," she teases.

Becoming an electrician starts with getting the right schooling. One can start quite early, even in High School. Many vocational programs in secondary schools have an electrical program. Following High School graduation, one can enter a program at a college to further their learning. Community colleges often have excellent trades program, including electrical. In addition to their typical general education courses like math and English, students will take practical courses where they learn both the science behind the trade and also get to apply and learn new skills in hands-on work. If one desires to learn more about the scientific end of things, they can attend a four year college that offers advanced programs like electrical engineering or similar majors. Community colleges are great because they offer students practical experience.

One can also do some extra work on their own to increase their skills and education. It is a great idea to find an experienced individual who works in the field and get close to them. An experienced worker can offer electrician training in the form of an apprenticeship or might be able to hire a student to work for them. They can also share the pros and cons of the industry, as well as stories from on the job. This will give the young student a better idea of what daily life is like as an electrical worker, and help them decide if this is really the field that they want to devote their life to. Working with a professional can help one meet others in the field and perhaps potential future customers. The pro may also have some suggestions for training programs or courses that the aspiring electrician can take advantage of. They can serve as a reference for the student's resume.

Before one can be successful in industry, they must have to proper education and training. Fortunately, budding electrical workers have many options to help them reach their goals and better themselves.

A Dream Within Eden

A Dream Within Eden Roleplay

I am currently looking for two slots to be filled, and once all profiles are done, I plan on getting it started. The Following are the two characters I need filled.

Lazarus, The King of Eden: Now the leader of the City of Eden as well as complete control of the Underground City. His military patrols the Underground City and it's factories to ensure that the people continue to work in peace, and put down any dissenters. As a political tool, he sends two platoons of soldiers out without knowledge of each other, and gives them orders to shoot anyone they see on sight. One platoon is defeated and killed, and Lazarus blames it on the scavengers outside. When he was younger, since his father refused to allow him to marry or have an heir, when Lazarus fell in love with Annabel, he was sent into the army. (The City in the Sea)

Master Eldorado: Is an old scholar who travelled with the original people that founded Eden. There he finds the old books pertaining to how the city originally was. He is strong in his belief that it can be restored back and searches for someone that can do just that. He lives in Eden where he continues to study and teach about the history. He lives alone, sacrificing his own love life to see the city shine like it once had. He taught Leonard and Lenore hoping that they would be the ones to do just that. Now he works with the Lenore, Annabel, and others to try and get rid of Lazarus. He holds onto a book that is forbidden to anyone. He keeps it hidden in a small library that he keeps hidden away from everyone. No one, not even the people who was with him at the time Eden was found, knows about it. (Eldarado)

The characters are based on Edgar Allan Poe's poems. The titles of the poems are at the end of each small character Bio. Keep in mind these are just a basic outline of the character, and you will be the one to design the character as you see fit, as long as they match the small bios.

There are a total of 12 set characters, so having more characters may add some stress to the plot, but I am willing to discuss this and work it out if I think you have an intriguing character idea and how they can fit in.

I am not using the Edgar Allan Poe's stories to base characters, as some of his stories are a tad long, so instead some plots of his stories may be included along the story line. How that will work.. Well they will be used as twists to the story. You CAN however also use his stories as a background/history if you so wish. I will not limit the character design to strictly the poems, but as long as the character fits with the plot and story, I will be more likely to accept them. (again this will need to be discussed with me first.)

I would very much prefer that these two slots be filled first before I even consider other character ideas.

Thomas Turney turns his keen eyes to what is one of the key issues on solving the economic situation within the state of California, locally as well as nationally.

Salient points:

-Use of the internet and engage students with computers used in classrooms and at home. Students can work at their own pace and there would be less ?dumbing down? of curriculum or even teaching to meet state or federal test standards. Learning at the student?s personal pace is something that should be seen as important.

?Education is not just for K-12 or college level. It?s a life-long process and whether it?s for personal gain or to improve one?s work skills, education should be available to all who seek it regardless of age. MBA?s from major institutions with online instruction are available today.

?The hot sectors of technology that education should be focusing on in terms of training ? whether it?s vocational or degree-oriented include medical technology particularly diagnostic procedures.

?Computers and wireless revolution will evolve particularly looking at cloud computing. IT security when it comes to cloud computing will be ramping up as well as reflected by the breaches of major corporations . Hackers will always be attempting to breach the security and one has to realize that you need redundant back-ups for security purposes.

However the ease and simplicity (and lack of physical hardware) will outweigh the security risks providing that companies and people realize that they need to have stellar security in place. More apps are going to move to the cloud because IT labor is very expensive. By moving things to the cloud, makes it more affordable when there?s less hardware and maintenance costs. It does not mean you don?t need IT people or people or apps to cover security, but just less employees. The evolution and innovation of technology will create new sectors and new jobs to be filled while others are down-sized or less in demand.

?Social media and its evolution was discussed in this podcast as well with new destinations like Namesake.com and other developments. The concern about social media from an investor?s perspective is the crowded space and some social media platforms are over-valued. There is discussion of Pandora and when if ever they will be worth their valuation in real dollars. The competition in social media makes it hard to achieve those important benchmarks. (The question begs to be asked will social media apps and platforms EVER make their IPO valuations?)

?Outsourcing of labor costs has made the cost of the products so much less.. which affects labor costs here in the US because we need to be more competitive . The standard of living has gone down 30% and the social divide has created a significant difference between the haves and the have nots.
